Online Competition Payment Terms and Conditions

1. Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

“Content” means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site; “county name” means Gloucestershire Golf Union and trading name/address; “Service” means collectively any online facilities, tools, services or information that Gloucestershire Golf Union makes available through the Web Site either now or in the future; “System” means any online communications infrastructure that Gloucestershire Golf Union makes available through the Web Site either now or in the future. This includes, but is not limited to, web-based email, message boards, live chat facilities and email links; “User” / “Users” means any third party that accesses the Web Site and is not employed by Gloucestershire Golf Union and acting in the course of their employment; and “Web Site” means the website that you are currently using www.gloucestershiregolfunion.co.uk and any sub-domains of this site unless expressly excluded by their own terms and conditions.

2.1 All Content included on the Web Site, unless uploaded by users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Gloucestershire Golf Union our affiliates or other relevant third parties. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other relevant laws.

2.2 Subject to sub-clause 2.3 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by Gloucestershire Golf Union

2.3 Material from the Web Site may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

7.1 To the maximum extent permitted by law, Gloucestershire Golf Union accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk.

7.2 Nothing in these terms and conditions excludes or restricts Gloucestershire Golf Union liability for death or personal injury resulting from any negligence or fraud on the part of Gloucestershire Golf Union

7.3 Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977. However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions. This term shall apply only within jurisdictions where a particular term is illegal.

8. No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

9. Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

10. Notices

All notices / communications shall be given to us either by post to our Premises (see address above). Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

11. Cancellation Policy

You can withdraw your competition entry by calling the County Secretary on 0793 6416775 or by email to secretary@gloucestershiregolfunion.co.uk and quoting your unique reference number. If you withdraw after the competition start sheet has been published your entry fee will not be refunded unless in exceptional circumstances.  If a championship or competition is cancelled for whatever reason a full refund of the relevant entry fee will apply.  The Championship Committee’s decision will be and deemed to final in the event of a dispute.

Photography Consent

By entering a Gloucestershire Golf Union event all competitors are consenting to being filmed or recorded (images and sound) by or on behalf of the Gloucestershire Golf Union, or another authorised third party, and consent to these images (or likenesses) being used in any film, recording, photograph or other footage (“recording”) in the promotion of Gloucestershire Golf Union activities.  All rights in the recording shall be owned by the Gloucestershire Golf Union or the authorised third party.  Competitors agree that any recording may be used by the Gloucestershire Golf Union or an authorised third party in any media and for any purpose throughout the world, including, without limitation, for promotional materials and activities, merchandise, or other commercial activities. Competitors acknowledge that no payment or compensation for use of their image or likeness shall be payable to them. Parental Consent

The safety and welfare of juniors at our Championships is paramount. It is important that we have a note of all relevant contact details, illnesses, medical condition and other relevant health details relating to all junior competitors so that their best interests are addressed. Junior Championship entries must be supported with a completed parental consent form with the assurance that the information you provide will be treated as confidential. It is the responsibility of the junior and their parent/guardian to notify the Gloucestershire Golf Union Championship Department if any of the details change at any time. Standards of Player Conduct

Every Championship or Match has a Code of Conduct Policy that will be strictly enforced. Competitors are to ensure that they are familiar with the Code of Conduct Policy, details of which can be found at www.gloucestershire.intelligentgolf.co.uk/policies-and-procedures

Privacy

This Website is provided by IntelligentGolf on behalf of Gloucestershire Golf Union. Gloucestershire Golf Union uses this website to provide online information and services, competition management and CONGU ratified handicap maintenance, for playing members within the County.

Access to this website is via Gloucestershire Golf Union Visitor ID and a User managed PIN number and is limited to Golf County Members and selected County staff who need access for the purpose of supplying and maintaining information relative to the primary functions of the website, as stated above.

Gloucestershire Golf Union will transfer from its own database system only those personal details relevant to County matters such that a County member may utilise this website effectively.

Users of the website are able to specify additional personal details by accessing the 'Preferences' area under the 'My Golf' menu option. The details specified here will be used solely for the following purposes:-

1) Communication between visitors to facilitate the management of matches and competitions

2) Communication between County Officials and competitors to promote accessibility and enable the effective and smooth running of the County.

3) Contact information may be passed to Gloucestershire Golf Union database system to maintain up to date contact information.
